Clarification Text on the Processing of Personal Data Through Cookies
This Clarification Text has been prepared by KMK Pack (“Company”) in its capacity as data controller, within the scope of Article 10 of the Law on the Protection of Personal Data No. 6698 (“KVK Law”) and the Communiqué on the Principles and Procedures to be Followed in Fulfillment of the Obligation to Inform.
Cookies, pixels, GIFs, and similar tracking technologies (“Cookies”) are small text files or codes that operate on your browser, placed on your devices such as tablets, phones, or computers during your use of online platforms like websites or mobile applications. Thanks to cookies, servers of our websites and applications can recognize your devices and enable, for example, the management of website traffic or remembering your language preferences. Cookies also help us analyze the number of visitors and audience of our website or application so that we can improve our software to offer you a better experience. Your personal data collected will be processed in accordance with the data processing conditions and purposes specified in Article 5 of the Law for the purposes (“Purposes”) listed below. Various cookies are used on the Website for different purposes. Depending on the type of cookie used, the purposes of data processing and the legal basis under the KVK Law may vary.
Mandatory Cookies (Always Active)
Mandatory cookies are those that are placed on your device during the use of the Website and are essential for the proper functioning of the online services offered. The data processing activities carried out using these cookies rely on the legal grounds specified in Article 5 of the KVK Law: “It is necessary for the processing of personal data of the parties to a contract, provided that it is directly related to the establishment or performance of the contract” and “It is necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.”
To Whom and For What Purposes Processed Personal Data May Be Transferred
In line with the above-mentioned Purposes, your personal data may be transferred, within the framework of our legitimate interests, to domestic consultants and IT infrastructure and technical cookie service providers from whom we receive services, to legally authorized public institutions and private organizations as required by law and our legal obligations, in accordance with the data processing conditions specified in Article 5 and the data transfer provisions of Article 8 of the KVK Law.
With your explicit consent, personal data processed through Google Analytics cookies (such as identifiers, device data) may be transferred to Google LLC located abroad for the purpose of analyzing user behavior on the Website through reporting. Likewise, for the purpose of offering personalized advertisements, personal data may be transferred to Meta Inc. located abroad, in accordance with the data processing conditions under Article 5 and the data transfer provisions of Article 9 of the KVK Law.

Rights of the Data Subject under Article 11 of the KVK Law
Under Article 11 of the KVK Law, you have the following rights regarding your personal data:

∙ To learn the purpose of processing and whether it is used in accordance with that purpose,
∙ To know the third parties to whom your personal data are transferred domestically or abroad,
∙ To request correction of personal data if it is incomplete or incorrectly processed, and to request notification of such correction to third parties,
∙ Despite being processed in accordance with the law, to request deletion or destruction of your personal data if the reasons for processing are no longer valid, and to request notification of such deletion to third parties,
∙ To object to any outcome against you that arises as a result of your personal data being analyzed exclusively through automated systems,
∙ To request compensation for damages incurred due to the unlawful processing of personal data.You may submit your requests regarding these rights to our Company by filling out the Data Subject Application Form available at https://www.kmkpack.com/en. Our Company will finalize your request free of charge as soon as possible and within no later than thirty days, depending on the nature of the request. However, if the process requires additional cost, a fee will be charged in accordance with the tariff determined by the Personal Data Protection Board.
